These Terms of Service (“Terms”) govern your access to and use of the website https://mimsoulrecords.com, related web pages, deep links (including mimsoul.radio), and the MimSoul mobile application for Android and iOS (together, the “Services”), operated by MimSoul Records (“we”, “us”, “our”).
By accessing, downloading, registering for, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 13 years old (or the minimum legal age in your country) to use the Services. If you are under 18, you should use the Services only with permission from a parent or legal guardian.
You are responsible for ensuring that your use of the Services complies with the laws of your country or region.
Most features require a registered account. You may sign up using email and password, Google Sign-In, or Sign in with Apple (on supported devices).
You agree to provide accurate information and keep your profile up to date. You are responsible for all activity under your account and for keeping your credentials secure. Do not share your account with others.
We may require email verification for certain actions. You are responsible for maintaining access to your registered email address.
The app may allow limited guest or anonymous access (for example: browsing radio or music). Guest users cannot access all features. Coins, purchases, PartyGram posting, social interactions, profile features, and other tools may require full registration and sign-in.
You may change your password through the in-app security flow where available. If you believe your account was compromised, contact support@mimsoulrecords.com promptly.
You may delete your account from within the app. Temporary deactivation may hide your profile for up to 60 days; if you do not log in within that period, your data may be permanently deleted. Permanent deletion cannot be undone. See our Privacy Policy for details. Admin accounts may not be self-deleted through the app.
MimSoul is an international online platform for underground electronic music culture. The Services currently include:
MimSoul Radio: live and streaming radio powered by third-party streaming infrastructure (Radio.co).
Music: a catalog of exclusive tracks published by MimSoul Records and its label artists. Users may browse, preview, purchase with MimSL coins, and download purchased tracks for personal use within the app.
Earn (MimSL): a virtual coin system. Users may complete tasks, engage with content, and receive rewards subject to app rules and manual review where applicable.
PartyGram: a social feed where users share photos and captions about party moments, music creation, or live performance. Users may like, comment, mention others, report content, and block users.
Notifications: optional push alerts about music, social activity, and account updates (when enabled).
Sharing: tools to share app content or links, including to third-party platforms such as Instagram Stories, where supported by your device.
Deep links: links such as mimsoul.radio/track/... may open content directly in the app when installed.
Music in the catalog is published by MimSoul Records and label artists.
Users cannot upload, distribute, or sell their own music through the app.
We may add, change, suspend, or remove any feature at any time.
MimSL is a virtual in-app reward. MimSL coins:
The coin economy is under active development. Rules, amounts, and features may change. In-app notices may state that current rules apply until a published date (for example through 2027).

Task submissions may require proof (screenshot, link, or file). Proofs are reviewed manually. Approval is not guaranteed. Fraudulent or misleading submissions may result in denial of rewards and account action.

Coin spending is generally final once confirmed on our servers.
Coin withdrawal or cash-out is not currently available in the app. If we enable it in a future update, additional terms and verification will apply.
Some tracks offer an optional YouTube License (currently 1,600 MimSL when enabled). This is separate from a regular purchase. After purchase, a license confirmation email is sent to the email you provide. That email is your official proof of rights.
You must follow all license conditions:
The YouTube License is for YouTube use only, under these conditions. It does not grant broad commercial sync rights, sample clearance, or rights on other platforms unless stated in the license email.
Purchased tracks may be cached or downloaded on your device for personal use within the app. You may not share purchased files publicly, upload them to file-sharing sites, or use them beyond your granted license.
PartyGram is for sharing authentic moments related to parties, music creation, or performance.
By posting, you confirm your content fits these categories and complies with these Terms.
Posts may be reviewed randomly or after reports. Compliant posts may earn coin rewards. Violating posts may be removed; rewards may be denied; penalties may apply.
Violation escalation (as implemented in the app):
We may also warn you, remove content, lock coins, restrict features, or ban accounts at our discretion.
Users may report posts for reasons including spam, harassment, inappropriate content, and intellectual property concerns. We review reports but are not obligated to take action in every case.
Users may block others. Blocked users are limited from interacting with you as defined in the app.
You may mention other users in posts and comments. Do not use mentions to harass or spam. You are responsible for content you publish.
Radio streams are provided through third-party infrastructure. Stream availability, quality, and interruptions may vary by network, device, and region.
The app may embed or link to third-party content (for example YouTube videos). That content is subject to the third party’s terms and availability.
You retain ownership of content you post. You grant MimSoul Records a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, distribute, and moderate your content within the Services and for reasonable promotion of the platform.
You represent that you have the right to post your content and that it does not violate law or third-party rights.
We may remove or restrict content at any time, with or without notice.
MimSoul (mimsoulrecords, MimSoul Records) names, logos, app design, radio branding, and platform materials are owned by
Mimsoulrecords LLC or licensors.
Music, artwork, and releases in the catalog are owned by MimSoul Records and/or the respective artists and rightsholders. Your purchase grants only the limited rights described in these Terms and in any license email.
You may not copy, scrape, redistribute, reverse engineer, or commercially exploit the Services or catalog except as expressly permitted.

We may investigate and cooperate with law enforcement where required.
We reserve the right to monitor activity, review content, approve or deny task rewards, adjust coin balances, remove posts, suspend features, and terminate accounts at our reasonable discretion to protect the community and the platform.
Our decisions on moderation and rewards are generally final, except where applicable law requires otherwise.
The Services rely on third parties including Firebase (Google), Google Sign-In, Apple Sign-In, Cloudflare R2, Radio.co, YouTube, Instagram/Meta sharing APIs, Beatport, Spotify links, and others. Your use of those services is also governed by their terms and privacy policies.
We are not responsible for third-party websites, apps, outages, or policy changes.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted streaming, error-free operation, permanent availability of any track, or that rewards will always be granted.
MimSL coins are virtual rewards, not money. We do not provide financial, legal, or tax advice.
TO THE FULLEST EXTENT PERMITTED BY LAW, MIMSOUL RECORDS AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN REAL MONEY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless MimSoul Records from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your violation of these Terms, or your violation of any third-party rights.
The Services are offered internationally online. These Terms are governed by the laws described in Section 17.
If you are located in a country where mandatory consumer protection, privacy, or other laws give you rights that cannot be waived by contract, those mandatory rights remain in effect to the extent required by law, even if not expressly restated here.
Nothing in these Terms limits rights you may have under applicable data protection laws (such as GDPR for users in the EEA/UK, where applicable).
These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law rules.
You agree that disputes arising from these Terms or the Services shall be brought in the state or federal courts located in Missoula County, Montana, USA, and you consent to their jurisdiction, unless applicable law in your country requires a different forum for consumers.
Before filing a claim, we encourage you to contact support@mimsoulrecords.com so we can try to resolve the issue informally.
We may update these Terms at any time. The updated version will be posted at https://mimsoulrecords.com/terms-of-service with a revised “Last updated” date. Continued use after changes constitutes acceptance. For material changes, we may provide additional notice in the app or by email where appropriate.
